Addendum:

1. Liquidated Damages (Ending Fixed Term Early)
If the Tenant(s) ends the fixed term tenancy before the agreed-upon end date, except in accordance with the Residential Tenancy Act (RTA), the Tenant(s) agrees to pay the Landlord CAD$5,400.00 (equivalent to 2 months' rent) as liquidated damages. This amount is an agreed estimate of the Landlord's costs to re-rent the unit (advertising, administration costs, etc.). By agreeing to this clause, the Landlord and Tenant(s) waive the right to claim any further re-renting costs. This payment does not release the Tenant(s) from the responsibility to pay rent until the Landlord re-rents the unit or until the original termination date of the fixed term agreement is reached.
2. Cleaning at End of Tenancy
At the end of the tenancy, the Tenant(s) must leave the rental unit reasonably clean and undamaged at a level that a new Tenant(s) would expect to move in. The Landlord may deduct reasonable and verifiable costs for excessive cleaning from the security deposit, in accordance with the RTA, provided an inspection report is completed.
3. Prohibited Substances (Smoking, Vaping, Cultivation)
Smoking (including tobacco and cannabis), vaping, and the cultivation/production of any illegal or legal substances are strictly prohibited anywhere on the residential property, including the rental unit and any common areas.
4. Keys, Fobs, and Access Devices
The Tenant(s) is responsible for the return of all keys and access devices provided at the start of the tenancy. The Tenant(s) must reimburse the Landlord for the replacement cost of any lost, damaged, or additional keys or fobs required during the tenancy.
5. Alterations, Painting, and Wall Penetrations
No alterations, installations, painting, or permanent modifications may be made to the rental unit without the Landlord's prior written consent. The Tenant(s) must obtain written consent before using any nails or screws on the walls.
6. Tenant's Insurance
The Tenant(s) must obtain and maintain Tenant's liability insurance (minimum of $300,000 liability coverage recommended) and contents insurance for the entire duration of the tenancy and provide the Landlord with proof of coverage within one month of the tenancy start date.
7. Landlord's Insurance (For Information Only)
The Landlord agrees to maintain valid landlord insurance on the property throughout the entire duration of the tenancy. Note: This clause confirms the Landlord's obligation, but the Tenant(s) cannot enforce this through an RTB dispute unless a specific loss occurred due to the lack of required insurance.
8. Waiver of Liability (Modified for enforceability)
The Landlord is not liable for loss or damage to the Tenant(s)'s or guests' personal property unless the loss is a direct result of the Landlord's negligence or breach of a lawful duty or the Residential Tenancy Act.
9. Subletting and Assignment
Subletting or assigning the tenancy is not permitted without the Landlord's prior written consent. The Landlord must not unreasonably withhold consent if the request is made in accordance with the RTA.
10. Illegal Activities
The Tenant(s) must not conduct any illegal activities or permit illegal activities to occur on the rental property. The unit is to be used strictly for residential purposes.
11. Storage of Possessions
All possessions and property of the Tenant(s) stored on the property shall be at the Tenant(s)’s risk of loss, theft, or damage from any cause whatsoever.
12. Fees for Late Rent or Dishonored Payments
If an N.S.F. (Non-Sufficient Funds) cheque is submitted or a payment is dishonored by the bank, the Tenant(s) is responsible for the exact service fee charged by the Landlord's bank.
If rent is paid late, the Tenant(s) will pay a late fee of $25.00 per late payment, provided this fee is agreed upon in this agreement.
13. Occupants and Visitors
The occupants of the unit are limited to those listed on the tenancy agreement. No other permanent occupants may reside in the unit without the Landlord's prior written consent. The Tenant(s) is responsible for the conduct of all visitors and ensuring they adhere to the policies outlined in this agreement and addendum.
14. Strata Law and Bylaws
The Tenant(s) agrees to abide by all Strata Corporation bylaws and rules. A copy of the current bylaws has been provided to the Tenant(s). A breach of the Strata bylaws that significantly interferes with the landlord's rights will result in an eviction notice.
15. Property Inspections
The Tenant(s) agrees and understands that the Landlord will conduct periodic prudent inspections of the property, in accordance with the Residential Tenancy Act (which requires 24 hours written notice).
16. No Pets
No pets of any kind are permitted on the property at any time during the tenancy.
17. Breach of Material Term
If the Tenant(s) violates a material term of the tenancy agreement or this addendum, the Landlord may serve a Notice to End Tenancy for Cause (One Month Notice to End Tenancy).
18. Condition of the Rental Unit and Strata Property
The Tenant(s) acknowledges that they have inspected the rental unit, including any appliances and fixtures, and are satisfied with the current condition and state of cleanliness. The Tenant(s) also acknowledges their understanding and acceptance of the condition of the strata property and common areas as of the move-in date.
